REVISED MODEL CODE OF CONDUCT
SC judgment in Subramania Balaji Vs Govt of TN on freebies. Normally poll promises are not corrupt practive but to have level playing field proper guidelines necessary.Normally manifesto before election date –EC cannot interfere but to be controlled.
EC sought opinion-some parties said yes- some said it is their democratic right-people to know how will they achieve.
EC framed guidelines and sought opinion
No promise in violation of Constitution/violate model Code
Should not use undue influence on voters
Manifesto indicate how the promises can be met.
7 REVISED CODE OF CONDUCT
GENERAL CODE OF CONDUCT
1)No criticism on caste/religion
2)No criticism on private life
3)No appeal on caste/ religion votes
4)No corrupt practive
5)No picketing of individual house on difference
6)No use of private building without permission
1) Inform Police well in adfvance to make arrangement
2) Follow Sec 144 and if necessary request execption
3)Obtain permission for loudspeaker
4) Proper bandobust-Organiser not to take action against rtrouble shooter.
1)Decide route in advance –No deviation
2)Inform Police 3)No hindrance to traffic 4)Ensure Sec 144 followed if in force 5)Mostly on right side of the road6)If two parties on same day consult and decide 7)No burning of effigies
IV) POLLING DAY
1)Cooperate with officers 2)issue identitiy card to agents 3)Their poll slips donot contain symbol 4)don’t serve liquor 5)Don’t allow croawd to gather 5)No flag/symbol near booths.
Only voter and agents with valid pass can enter booths
If any problem complain to observers.
VII PARTY IN POWER
Not to misuse official position
Minister shall not use official work with campaigning
No use of Govt transport while probagating
No monopolising of public place-to bne used by other parties also
Similarly no monopolising of govr guest House-use for rest not for campaing party office
No Advt at Govt cost
Ministers not to use discretionary funds
No financial grant –no stone laying-no promise of construction of road- no ad hoc appointment
Ministers shall not enter Polling Station ofr place of counting except as candidate
EC to announce 3 weeks before notification
